1. Booking and Confirmation:
- All service requests are subject to availability and confirmation by AERIVI and our partners (e.g., airlines, hotels, activity providers).
- To initiate a booking, the Client must provide accurate and complete information as requested.
- A booking is considered confirmed only upon the Client’s acceptance of our written confirmation and payment of the specified deposit or full payment, as outlined in the booking agreement.
- AERIVI reserves the right to refuse any booking at its sole discretion.
- Quotations are valid for a specified period and are subject to change without notice.
2. Payment Terms:
- Payment terms, including deposit amounts, final payment deadlines, accepted payment methods, and cancellation policies, will be specified in the booking agreement.
- Full payment is typically required a certain number of days prior to the commencement of services, as indicated in the booking agreement.
- Failure to make timely payments may result in the cancellation of your booking.
- All prices are quoted in [Specify Currency, e.g., EUR] and are inclusive/exclusive of applicable taxes as specified.
- Additional charges may apply for changes or amendments requested by the client after the booking is confirmed.
3. Private Flight Arrangements:
- AERIVI acts as an agent in arranging private flights and does not operate the aircraft. The contract for the flight is between the client and the operating carrier.
- Flight schedules and availability are subject to the operating carrier and may be subject to change due to operational reasons, weather conditions, or other unforeseen circumstances. AERIVI will endeavour to inform the client of any significant changes when reasonably possible.
- The client is responsible for ensuring that all passengers possess valid passports, visas, and any other required travel documents. AERIVI is not liable for any issues arising from invalid or missing travel documents.
- Specific terms and conditions of the aircraft operator, including but not limited to baggage restrictions, check-in procedures, and liability limitations, will apply to the flight. AERIVI will provide these where available.
4. Hotel Bookings:
- AERIVI acts as an agent in arranging hotel bookings. The contract for accommodation is between the client and the hotel.
- Hotel check-in and check-out times are subject to the policies of the respective hotel.
- Room availability and specific requests (e.g., room type, amenities) are subject to confirmation by the hotel.
- Cancellation and amendment policies vary by hotel and will be communicated to the client at the time of booking. The client is responsible for adhering to these policies and any associated fees.
- AERIVI is not responsible for the services provided directly by the hotel.
5. Private Driver Services:
- AERIVI facilitates the arrangement of private driver services with independent providers. The contract for driver services is between the client and the driver/transport company.
- The scope of private driver services will be outlined in the booking agreement, including duration, mileage (if applicable), and areas of service.
- The client is responsible for providing accurate pick-up and drop-off locations and times.
- Waiting times beyond a reasonable limit may incur additional charges payable directly to the driver or the transport company.
- AERIVI will use reasonable endeavours to ensure that drivers are licensed and vehicles are appropriately insured, but the ultimate responsibility lies with the service provider.
6. Activity Bookings:
- AERIVI acts as an agent in arranging activities and excursions provided by independent operators. The contract for the activity is between the client and the activity provider.
- Availability, schedules, specific terms and conditions, and safety regulations are determined by the activity provider.
- Cancellation and amendment policies vary by activity and will be communicated to the Client at the time of booking.
- AERIVI is not responsible for the safety, quality, or execution of services provided directly by the activity provider.
- The client may be required to sign waivers or other legal documents directly with the activity provider prior to participating in the activity.
7. Changes and Cancellations by the Client:
- Requests for changes or cancellations must be submitted in writing to AERIVI.
- Changes and cancellations are subject to the policies and fees imposed by the respective service providers (e.g., airlines, hotels, activity organisers). The client acknowledges that these policies are beyond AERIVI’s direct control.
- AERIVI will endeavour to assist with change or cancellation requests but cannot guarantee their acceptance and will not be responsible for any associated costs or penalties imposed by the service providers.
8. Changes and Cancellations by AERIVI:
- While we strive to provide the services as confirmed, AERIVI reserves the right to make changes to or cancel bookings due to unforeseen circumstances, including but not limited to force majeure events (e.g., natural disasters, political instability, pandemics), operational issues with service providers, or other events beyond our reasonable control.
- In the event of a significant change or cancellation by AERIVI, we will endeavour to offer suitable alternative arrangements or a refund of payments made for the affected services.
- AERIVI shall not be held liable for any indirect, consequential, or incidental losses, damages, or expenses incurred by the Client due to changes or cancellations beyond our direct control.
9. Limitation of Liability:
- To the maximum extent permitted by Portuguese law, AERIVI’s liability for any direct loss or damage arising out of or in connection with our services shall be limited to the total amount paid by the client to AERIVI for the specific booking in question.
- AERIVI shall not be liable for any indirect, consequential, incidental, special, or punitive damages, including but not limited to loss of profits, loss of enjoyment, or travel disruptions, except where such damages are caused by our direct negligence or wilful misconduct.
- AERIVI is acting as an agent for third-party service providers (e.g., airlines, hotels, activity organisers) and shall not be liable for their acts, omissions, or the quality of their services. Any claims related to these services should be directed to the relevant provider.
10. Insurance:
- It is strongly recommended that the client obtain comprehensive travel insurance to cover unforeseen circumstances such as trip cancellations, delays, medical emergencies, loss of baggage, and other potential risks associated with travel and the services provided by our partners.
- AERIVI does not provide travel insurance and accepts no responsibility for any losses or damages incurred by the Client that could have been covered by insurance.
11. Client Responsibilities:
- The client is responsible for providing accurate and complete information necessary for the booking and delivery of services.
- The client is responsible for ensuring they and their travel party possess all necessary travel documents (e.g., passports, visas, health certificates) as required by relevant authorities and service providers.
- The client agrees to comply with all terms and conditions imposed by the service providers (e.g., airlines, hotels, activity organisers).
- The client is responsible for their conduct and safety during the provision of services.
- The client is expected to treat AERIVI’s staff and the staff of service providers with respect.
12. Intellectual Property:
- All content on AERIVI’s website, marketing materials, and other communications, including but not limited to logos, trademarks, text, images, and designs, are the intellectual property of AERIVI or our licensors and are protected by applicable laws.
- The client may not use, reproduce, or distribute AERIVI’s intellectual property without our prior written consent.
13. Data Privacy:
- AERIVI will collect, use, and process the Client’s personal data in accordance with its Privacy Policy, which is available on our website www.aerivi.com. By using our services, the client consents to the terms of our privacy policy.
14. Governing Law and Dispute Resolution:
- These Terms and Conditions shall be governed by and construed in accordance with the laws of Portugal.
- Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal, unless otherwise agreed in writing.
15. Amendments:
- AERIVI reserves the right to modify or update these Terms and Conditions at any time without prior notice. The latest version will be posted on our website, www.aerivi.com. Continued use of our services after any such changes constitutes your acceptance of the revised Terms and Conditions.
16. Entire Agreement:
- These Terms and Conditions, together with the booking agreement and any other documents expressly incorporated herein, constitute the entire agreement between the Client and AERIVI with respect to the services provided and supersede all prior or contemporaneous communications and proposals, whether oral or written.
